Welcome to Cviisual Art Studio (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website https://cviisualartstudio.com (“Website”), the purchase of products (including original artworks, prints, and art supplies), and enrolment in art classes offered by Cviisual Art Studio. By accessing or using our Website, purchasing products, or enrolling in classes, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.

  1. Definitions
  • “Website”: Refers to https://cviisualartstudio.com and all its associated pages and content.
  • “Products”: Refers to any physical or digital goods offered for sale on the Website, including but not limited to original paintings, drawings, prints, ceramics, and art supplies.
  • “Services”: Refers to any services offered, including but not limited to custom artworks, art lessons, workshops, and consultations.
  • “User,” “You,” “Your”: Refers to any individual accessing or using the Website, purchasing Products, or enrolling in Services.
  • “Art Classes”: Refers to any lessons, workshops, or courses, whether online or in-person, offered by Cviisual Art Studio.
  1. General Conditions
  • We reserve the right to refuse service to anyone for any reason at any time.
  • You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Website, use of the Service, or access to the Service or any content on the Website without express written permission by us.
  1. Products

3.1. Product Descriptions and Availability

  • We make every effort to display as accurately as possible the colours and images of our products that appear on the Website. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
  • All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
  • While we strive for accuracy, products may occasionally be out of stock, or errors in pricing or description may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Website or on any related Service is inaccurate at any time without prior notice (including after you have submitted your order).

3.2. Pricing and Payment

  • All prices are in Australian Dollars (AUD) unless otherwise stated, and include Goods and Services Tax (GST) where applicable for Australian customers. For international customers, prices are displayed in their local currency where applicable, but the final transaction will be processed in AUD.
  • Payment for all products and services must be made in full at the time of purchase through the payment gateways provided on our Website (e.g., Stripe, WooPayments).
  • We use secure payment gateways. We do not store your credit card details.

3.3. Shipping and Delivery

  • We ship products to Australia, USA, Canada, and Singapore.
  • We offer FREE SHIPPING Australia wide!
  • International Shipping costs are calculated at checkout and are dependent on the size, weight, and destination of the order.
  • Estimated delivery times are provided for guidance only and are not guaranteed. We are not responsible for delays caused by shipping carriers or customs.
  • International customers are responsible for any customs duties, taxes, or import fees levied by their respective countries.
  • Risk of loss and title for items purchased from us pass to you upon our delivery to the carrier.

3.4. Original Artworks

  • Each original artwork is unique. Minor variations in colour or texture from the online representation may occur due to photography and screen differences.
  • The sale of an original artwork does not transfer copyright. All intellectual property rights, including copyright, remain with the artist, Cviisual Art Studio, unless explicitly agreed upon in writing.
  1. Art Classes and Workshops

4.1. Enrolment and Payment

  • Enrolment in art classes is subject to availability.
  • Full payment is required at the time of booking to secure your spot.
  • Prices for art classes are subject to change without notice.

4.2. Cancellations and Refunds (Art Classes)

  • By You:
    • Cancellations made 7 days or more prior to the class start date will receive a full refund or credit.
    • Cancellations made within 7 days of the class start date are non-refundable but may be eligible for a credit towards another class at our discretion, or you may transfer your enrolment to another person.
    • No refunds or credits will be issued for no-shows or cancellations on the day of the class.
  • By Us:
    • Cviisual Art Studio reserves the right to cancel or reschedule a class due to unforeseen circumstances (e.g., insufficient enrolments, instructor illness). In such cases, you will be offered a full refund or the option to transfer your enrolment to another class. We will endeavour to provide as much notice as possible.

4.3. Class Conduct

  • Participants are expected to behave respectfully towards instructors, other students, and studio property.
  • We reserve the right to remove any participant from a class who is disruptive or whose conduct is deemed inappropriate, without refund.
  • Participants are responsible for their own safety and belongings during in-person classes.
  1. Custom Artworks
  • Custom artwork commissions require a separate agreement outlining the scope of work, timeline, pricing, and payment schedule.
  • A non-refundable deposit may be required before work commences.
  • Revisions and approval processes will be specified in the custom artwork agreement.
  • Once commissioned work is complete and delivered, further changes may incur additional fees.
  1. BlueThumb Online Gallery
  • Some of our artworks may be listed and sold through BlueThumb.com.au. Purchases made via BlueThumb are subject to BlueThumb’s own Terms and Conditions of Sale. Please refer to their website for details regarding those transactions.
  1. Intellectual Property
  • All content on this Website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Cviisual Art Studio or its content suppliers and protected by Australian and international copyright laws.
  • The Cviisual Art Studio name and logo are trademarks of Cviisual Art Studio. You may not use these without our prior written permission.
  • By contributing content (e.g., blog posts for “My Journey”), you grant Cviisual Art Studio a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Cviisual Art Studio for all claims resulting from content you supply.
  1. User Accounts
  • If you create an account on our Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
  • We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
  1. Links to Third-Party Websites
  • Our Website may contain links to third-party websites or services that are not owned or controlled by Cviisual Art Studio.
  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Cviisual Art Studio shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

  1. Limitation of Liability
  • To the maximum extent permitted by applicable law, in no event shall Cviisual Art Studio, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

  • You agree to defend, indemnify and hold harmless Cviisual Art Studio and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Website, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Website.

  • These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
  • Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
  1. Changes to These Terms
  • We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
  • By continuing to access or use our Website after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Website.
